About

1. Fee (project milestone) to prepare and file a new application is $225 which includes: - a screening search to check for potential conflicts with existing registrations - classifying the goods/services to qualify for the lowest government filing fee - filing the application as the appointed US attorney - adding the application to the attorney's docketing system to monitor the progress and track deadlines - forwarding the Amazon Brand Registry verification code if applicable 2. Fee (project milestone) for one class of goods/services the cost of USPTO filing is $350 (which is $575 minus the previous project milestone fee of $225) After the application is filed the remaining steps are: 3. In about 5 months the Trademark Office conducts an initial examination and notifies us of any issues to be resolved. If no issues are raised then the application proceeds without additional legal fees. If the examiner requires minor changes, the attorney resolves those for $100. If the examiner issues an initial refusal, the attorney's fee for a basic argument is $250 and a complex one requiring research and evidence costs $495. 4. After any issues are resolved the application will be published for opposition, giving other trademark owners a chance to oppose the application. If someone opposes the application, the attorney will advise the client on next steps and provide a cost estimate based on the attorney's experience handling 100+ opposition and cancellation proceedings. 5. For an application based on intended use, the final step before registration is to file proof of use. The cost to file a Statement of Use in one class is $325 ($175 attorney fee and $150 USPTO filing fee). If US sales have already begun and we file the application based on actual use, then this step 5 does not apply. 6. When the registration certificate issues, the attorney makes sure the client has the registration details along with future renewal dates, and will also add those dates to the attorney's trademark docketing system.
